Copyright and Terms of Use.
(1) Renter acknowledges that the GPS unit is the property of FUNfinder Inc. and is received in good condition, mechanical and otherwise. Renter shall return unit together with any accessories (if rented) to location designated by company for return in the same condition as when rented, on or before the due date designated on the rental contract.
(2) Rentals shall be no longer than 30 days unless client has entered into a long term rental agreement. Renter understands that all rental fees will be charged at time of rental. In addition, a security deposit will be required in the amount of the replacement value of the GPS unit.
(3) In the event of an extension to the rental, additional fees will be processed and billed to the renter’s credit card at the time of the extension. The authorization of extension to the rental may only be made by the individual named on the rental contract. Verification of renter will be required if extension is made by telephone, by verbal verification of personal information supplied at the time of rental. Example: date of birth, identification number or other such recorded data.
(4) In the event the renter fails to notify FUNfinder Inc. of their intention to rent the GPS unit for additional days, FUNfinder shall assume the renter has chosen to purchase the unit and, in addition to paying the rental fees, will be charged for the cost to replace the unit after a period not to exceed 5 days.
(5) The company may (a) exchange (b) demand the return of, and /or(c) take possession of the unit from Renter at any time for any reason.
(6) Renter agrees to pay company with or without written demand the following: (a) all applicable rental fees and other charges (damage waiver, accessory equipment, etc) at the stated rates until the GPS unit and equipment is returned to the FUNfinder rental location specified on the rental contract or other authorized location as designated by company (b) a sum equal to the value of all accessories and equipment not returned with the GPS unit and/or (c) all collection charges, including reasonable attorney fees, court costs, and all other fees or expenses incurred by company in securing and returning the GPS unit and/or other rented equipment to FUNfinder Inc., or in enforcing any of the terms of this contract.
(7) Under no circumstances shall the rented unit be used in the following manner: (a) in violation of any terms of this contract, (b) for any illegal purposes and or (c) by leaving GPS unit in an unlocked vehicle or leaving GPS unit unsecured while under control of the renter. Renter is responsible for replacement cost of unit in the event the unit is stolen, lost or misplaced.
(8) Renter is responsible for all damages to the rental unit in the event the renter does not choose to purchase the Damage Waiver option (item 9). Renter agrees to reimburse FUNfinder Inc. for the actual cash value of all damages in replacing the rental unit and/or other rented equipment.
(9) If the rental customer accepts Damage Waiver at the time of rental and payment by renter for the additional Damage Waiver fee is obtained, and provided there is no violation to any terms and conditions of the rental contract, FUNfinder Inc. then agrees not to hold the renter responsible for damage to the unit.
Excluded by Damage Waiver are the following as allowed by state law: (a) Damage caused by willful or wanton misconduct by the renter or any other designated party authorized by the renter and/or (b) damage arises out of the use of the GPS unit while committing a criminal act.
Renter authorizes FUNfinder Inc. to process any credit card presented and documented for payment of this contract or apply any deposits left with company for security deposit in the name of renter for collection of any amounts due under this contract. Renter agrees that FUNfinder Inc. may make a credit inquiry and/or report with a credit bureau. Other charges may apply to calculation of rental charges if: (a) The GPS unit is not returned to an address specified on the rental contract, (b) if contract terms and conditions or rate rules are violated.
(10) Renter shall not permit any repairs or alterations to the GPS unit or accessories. Renter shall not download any other mapping software onto the GPS unit.
(11) Company makes no warranties either expressed or implied not limited to the condition of the equipment.
(12) In the event FUNfinder Inc. supplies any additional equipment (such as chargers, cases, mounting brackets, etc), Funfinder assumes no liability for the installation, use or misuse of the additional equipment.
(13) FUNfinder Inc. is not responsible for any harm damage, loss or misadventure that occurs as a result of the use of this GPS system and/or additional equipment.
